General Terms and Conditions (AGB)

§ 1 Validity of the General Terms and Conditions

All psychological counseling services provided by Franka Schneider, M.Sc. are exclusively subject to the following General Terms and Conditions (hereinafter: GTC). By sending a request to Franka Schneider, M.Sc., the client agrees to the validity of these GTC.

§ 2 Consulting services

Online psychological counseling, clinical psychological treatment and in-person counseling, and Walk & Talk sessions are scheduled and billed in units. One session or unit lasts 60 minutes. A double session lasts 120 minutes. The invoice will be calculated according to the price per unit offered on the website.
The initial consultation is an exception. This is offered once to each client, lasts a maximum of 30 minutes, and is free of charge.

 

The counseling aims to overcome psychosocial problems, promote personality development, set goals and activate resources, or provide support during private or professional conflicts, problems, transitions, and change processes. The counseling service does not offer a ready-made solution for the client. It is not intended to diagnose, cure, or alleviate illnesses, suffering, or physical injuries. Franka Schneider, M.Sc., does not make diagnoses, and psychological psychotherapy is not offered as part of the counseling.

§ 3 Range of services and terms of payment

Franka Schneider, M.Sc. offers counseling appointments as individual sessions or as a package service. The package services offer the client the opportunity to purchase several counseling services in advance and thus receive a discount compared to individually booked counseling services. Payment for a single unit of psychological counseling must be made by bank transfer within 7 days of receipt of the fee note. In the event of late payment by the client, default interest of 10% per year may be charged. In this case, Franka Schneider, M.Sc. will send a payment reminder. The package offers must be paid in full before the start of the counseling service. Health insurance billing is not possible. Payment is due upon conclusion of the contract and must be made no later than 48 hours before the first agreed appointment. The date of receipt of payment by the psychologist is decisive. Payment by the client must be made by transferring the agreed remuneration to the bank account specified in the counseling contract. An invoice for the amount paid will be issued at the end of the counseling relationship.

§ 3.1 Consulting assets

The following applies to consulting contracts that are concluded for several consulting sessions (i.e. the client books a consulting package and transfers a sum of money in advance to Franka Schneider, M.Sc. who manages it and retains the fee for the appointments made): The agreed consultancy services and the credit balance must be utilized in full by the client within a period of 24 months from the conclusion of the contract.

§ 4 Appointment agreement and cancellation fee

The individual appointments for counseling sessions are arranged individually in advance between Franka Schneider, M.Sc. and the client. In the case of package services, the appointment for the follow-up consultation is agreed at the end of a consultation session.


Appointments can be canceled/postponed free of charge 24 hours before an agreed appointment, after which the fee is due in full. If a session is canceled during the course of the session, the entire session will still be charged. In the event that a treatment/consultation process with pre-arranged appointments is canceled, these will not be charged if they are canceled in due time. If Franka Schneider, M.Sc. has to cancel an appointment less than 24 hours in advance, the client will not be charged for the next consultation appointment.

§ 5 Conditions and fee notes shown

For clinical psychological services such as counseling and treatment (online counseling, in-person appointments, or Walk & Talks), VAT is not charged in accordance with § 6 para. 1 no. 19 of the Austrian VAT Act (UStG), as these services are considered medical treatments. For workshops, lectures, teaching activities, and supervision, Franka Schneider, M.Sc., is exempt from the small business regulation according to § 6 para. 1 no. 27 of the Austrian VAT Act (UStG). Therefore, VAT is not charged. The prices displayed at the time of booking apply.

§ 6 Data protection and security

Information shared during psychological counseling is highly confidential and requires special protection. All information and data entrusted to psychologist Franka Schneider, M.Sc., will be stored with utmost care, adhering to data protection regulations and documentation and retention requirements. As a clinical psychologist, Franka Schneider, M.Sc., is bound by the German Psychotherapists Act 2019 (PsychThG) to maintain confidentiality regarding matters entrusted to her. If the online service offers the option to enter personal or business data (email addresses, names, etc.), the disclosure of this data by users is expressly voluntary. Franka Schneider, M.Sc., is committed to carefully safeguarding the personal data and information provided for the purpose of counseling and protecting it from unauthorized access by third parties. Clients are aware of this and consent to the psychologist storing the personal data necessary for processing the engagement on data storage devices. Clients expressly consent to the collection, processing, and use of their personal data for the purpose of fulfilling the consultation/treatment agreement. Data will not be shared with third parties.

Online counselling presents particular challenges to data protection.

 

Email providers like Gmail or GMX do not offer a particularly high level of security. Information shared through these services is usually transmitted unencrypted and stored on servers abroad. Therefore, interception by third parties cannot be ruled out. Using an encrypted email provider (e.g., ProtonMail) is therefore recommended.

§ 7 Advisory mandate and personal responsibility of the clients

The content and goals of the counseling sessions, or of individual sessions, are jointly defined between the client and Franka Schneider, M.Sc., during an initial consultation. Psychological counseling requires the client's active participation. The counseling process is voluntary, active, and self-directed, with Franka Schneider, M.Sc., acting as a facilitator. Both parties, especially the client, work to the best of their knowledge and ability to achieve a successful outcome. The client should be willing and open to engaging with themselves and their situation. The actual work of change is carried out by the client. The choice of method, as well as any modifications to it, is at the psychologist's discretion. The client acts responsibly and is aware of this responsibility at every stage of the collaborative work. They are fully responsible for their physical and mental health and well-being during the counseling sessions. All interventions undertaken by the client during counseling (under process guidance) remain their responsibility. Franka Schneider, M.Sc., points out that clients may experience an intensification of current emotions during clinical psychological treatment, counseling, and supervision. As a clinical psychologist, Franka Schneider, M.Sc., provides responsible and compassionate guidance and support throughout the entire process to the best of her knowledge and belief. Clients always act independently, even if something is unclear or impractical for them. Should any misunderstandings or ambiguities arise, clients are encouraged to contact the psychologist for clarification. No claims for damages, reductions in fees, or refunds can be made as a result.

§ 8 Acute crises

Online psychological counseling is not a substitute for clinical psychological treatment or examination, treatment, or therapy by physicians or psychotherapists. In particular, online psychological counseling is not suitable for acute mental health crises and pronounced mental disorders; instead, in-person psychotherapy is indicated. In acute emergencies, you should consult your family doctor or the nearest hospital. If an illness is present, this should be discussed with the psychologist.

§ 9 Online psychological counseling

Visiting the website of Franka Schneider, M.Sc., and accessing information about her services is free of charge. Online psychological counseling, in all its forms (video-based, audio, and/or chat-based), is subject to a fee based on a pre-arranged appointment. The only exception is the initial 30-minute consultation, which is free of charge. Franka Schneider, M.Sc., assumes no liability for quality issues or connection interruptions in the online setting that originate outside of her technical control. By scheduling an appointment, clients agree to Franka Schneider, M.Sc.'s pricing model.

§ 10 Technical requirements for online psychological counseling

Clients require up-to-date technology and internet access to use the services smoothly. Franka Schneider, M.Sc., cannot guarantee complete protection against viruses and other technical risks. Furthermore, she is not liable for uninterrupted or error-free access to the services.
Using these services can generate significant data usage, which can incur costs, especially when using mobile devices. The costs and risks associated with internet data traffic lie solely with the users. Users are advised to ensure adequate security for their computers to prevent unauthorized access to sensitive data. Users also acknowledge that, due to the inherent technical limitations of the internet, complete protection against viruses, Trojans, spyware, etc., is never possible. The video programs used for online counseling are free of charge and accessible via computer, laptop, mobile phone, or tablet. For video-based online counseling, users agree to find a quiet and undisturbed space for the sessions and, where possible, to eliminate all sources of distraction (email program, browser, telephone, etc.). During video counseling sessions, no one other than the client should be present in the room, unless this has been agreed upon with the psychologist beforehand. It is not permitted to make recordings (screenshots, video or audio recordings) of the conversation unless this has been agreed upon with Franka Schneider, M.Sc. If recordings are made, they may not be shared with third parties.

§ 11 Differences of opinion

Differences of opinion arising from the consulting/treatment/supervision contract and the General Terms and Conditions should be settled amicably. To this end, it is advisable to submit counter-arguments, complaints or divergent opinions of the other contracting party in writing.

§ 12 Liability for content

The contents of the website are created with the greatest care and conscientiousness. However, Franka Schneider, M.Sc. assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against Franka Schneider, M.Sc. relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are fundamentally excluded, unless there is evidence of wilful intent or gross negligence on the part of Franka Schneider, M.Sc.
All offers are subject to change and non-binding. Franka Schneider, M.Sc. expressly reserves the right to change, supplement or delete parts of the website or the entire offer without prior notice or to cease publication temporarily or permanently. She accepts no liability in the event that this website is unavailable for any reason at any time or for any period.

§ 13 Place of jurisdiction

For all disputes that cannot be resolved amicably, Munich is agreed as the place of jurisdiction. Clients declare their full agreement to these terms and conditions by placing an order, whether in writing or verbally. Any deviations from these terms and conditions must be in writing.

§ 14 Final provision

Franka Schneider, M.Sc. reserves the right to make changes to the GTC.
